Sending a photograph for assessment does not commit you to purchase anything.
Terms & Conditions
Simple, clear and
fair from the start.
We want you to know how Rememoir works before you decide to go ahead: what we will do, what we need from you, when payment is taken and what you can reasonably expect from the finished result.
We tell you what we recommend and what it will cost before paid production begins.
The movement we create is a new interpretation of a still photograph, not historical footage.
01
About these terms
These Terms & Conditions apply when you use Rememoir to submit a photograph for assessment or purchase a restoration, animation or related service.
Rememoir is a trading name of Allison Tech LTD, registered in Scotland. Company Number: SC639030.
In these terms, “Rememoir”, “we”, “us” and “our” mean Allison Tech LTD trading as Rememoir. “You” means the person asking us to assess or provide a service.
Nothing in these terms removes or restricts rights that UK consumer law gives you and which cannot lawfully be excluded.
02
How Rememoir works
Our normal journey is simple: you send us a photograph; we look at it and consider what may work well; we send you a private recommendation and price; you decide whether you would like to continue; if you do, payment is made securely before production begins; then we create, preview where appropriate, and deliver the finished work.
Sending a photograph for assessment does not commit you to purchase anything.
03
Sending us your photograph
Uploading a photograph through Get Started simply asks us to take a look at the image. It is not, by itself, an order and there is nothing to pay at that stage.
We may think the photograph is ready to work with, suggest restoration first, ask whether you have a clearer scan, or explain that we do not feel confident offering the result you have in mind.
Our recommendation is based on the photograph available to us at the time. It cannot guarantee that a particular movement, restored detail or exact final appearance can be achieved.
We may decline a request where we reasonably believe we cannot provide the service appropriately, or where we have concerns about rights, consent, legality, safety or misuse.
04
Your offer, price and payment
Before you pay, we will show you what we recommend, what is included and the price. Your offer is private to you and may reflect the particular photograph and work involved.
A paid order is formed when you accept the offer and successfully complete payment. We will provide confirmation in a form you can keep, such as email.
Unless we expressly agree otherwise, production does not begin simply because you uploaded a photograph or received an offer.
Prices are shown in pounds sterling. Any additional paid work will be explained before you agree to it, and we will not add optional paid extras through pre-selected choices.
Payments are processed securely by Stripe. Rememoir does not need to receive or store your full card number.
05
Changing your mind and starting work
Consumer cancellation rights depend on the type of service or digital content supplied and when performance begins. We will not use these terms to take away a cancellation right the law gives you.
Where you have a statutory 14-day cancellation period for a service, we will normally wait before starting unless you expressly ask us to begin during that period.
Where required by law, we will ask you expressly to request that work begins during the cancellation period and explain the consequences before starting. If you later cancel after requested work has begun, you may have to pay a proportionate amount for work already supplied. If the service is fully performed after the required request and acknowledgement, your cancellation right may end.
Where the transaction is legally treated as digital content, we will obtain any consent and acknowledgement required before immediate supply or download causes a statutory cancellation right to be lost.
If you want to cancel, contact us promptly and include your Rememoir reference.
06
Your photograph and permission to send it
You keep ownership of the photograph you submit, subject to any rights belonging to another photographer, rights holder or person.
By submitting a photograph, you confirm that you are entitled to provide it to us for the service requested and that our carrying out that service will not knowingly infringe another person's rights.
Where a photograph contains identifiable living people, you are responsible for considering whether you have appropriate permission or another proper basis to ask us to process the image for the requested purpose.
If a credible rights or privacy concern is raised, we may pause or decline work while we investigate.
07
About the movement we create
This is worth understanding before you order.
It is not historical footage and cannot establish how a person actually moved, smiled, looked around or behaved when the photograph was taken.
Because that movement is newly created, it can contain variation, approximation or occasional unexpected details. What works best depends heavily on the original photograph, including its quality, pose, facial visibility, damage, lighting and composition.
Examples on our website show the type of work Rememoir can create, but do not guarantee that every photograph will produce the same type or quality of result.
We will use reasonable care and skill in providing the agreed service, but we cannot promise a particular emotional reaction or that the movement created will exactly match how you imagine the original moment.
08
Photo restoration
Restoration may involve reducing marks, repairing visible damage, improving tone, contrast or clarity, and reconstructing areas that are missing or unclear.
Where original visual information has been lost, reconstructed detail is necessarily an interpretation. We cannot guarantee that reconstructed clothing, facial detail, backgrounds, colours or other missing features are historically exact.
If accuracy of a particular feature matters to you, tell us before work begins.
09
Your private preview and adjustments
Where appropriate, we may provide a private preview before final delivery. A preview may be lower resolution, watermarked or otherwise presented as a review copy.
If something in the preview does not feel right, tell us. We will consider reasonable adjustments that could improve the work we agreed to create.
A reasonable adjustment is different from asking for a substantially different result, changing the original brief, supplying another photograph or requesting new work outside the service purchased. If something would amount to additional work, we will explain that before charging anything further.
A preview does not reduce statutory rights you may have where a service has not been provided with reasonable care and skill or does not conform to what was agreed.
10
Timescales and delivery
Any delivery estimate will be based on the work involved and our workload. If we agree a specific deadline, we will treat it as part of the agreement.
If no specific time has been agreed, we will provide the service within a reasonable time.
Finished digital work will normally be delivered electronically. You are responsible for providing a working email address and for downloading and keeping your finished files once delivered.
Our Privacy Policy explains how long working photographs and generated files are normally retained. Rememoir is not intended to be a permanent cloud archive.
11
Ownership and use of finished work
You retain whatever rights you already hold in your original photograph.
Once you have paid for the agreed service, you may use the finished customer-delivery file for personal, non-commercial purposes, including keeping it, showing family and friends, and sharing it on your personal social-media accounts.
If you want commercial, advertising, resale, broadcast, merchandise or other business use, speak to us first so we can confirm what rights and third-party technology terms apply.
We do not assume permission to publish your original photograph or finished Rememoir in our marketing, portfolio, examples or social media. We will ask separately.
Rights in Rememoir branding, website materials, templates, software and processes remain with their respective owners.
12
Privacy and the services we use
Our Privacy Policy explains how we look after customer information and photographs, our normal 30-day working-file retention approach, and when specialist services may need to process an image to help us provide the work you have asked for.
Please read the Privacy Policy before submitting a photograph.
13
If something goes wrong
If you think we have made a mistake or the service does not match what we agreed, please contact us. We would always like the opportunity to understand what has happened and put things right where we reasonably can.
UK consumer law requires services to be performed with reasonable care and skill. Where applicable, legal remedies may include repeat performance or a price reduction if the service cannot be brought into conformity with what was agreed.
Nothing in these terms is intended to replace, reduce or exclude a remedy that consumer law gives you.
14
Our responsibility
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill, subject to limits the law permits.
We are not responsible for a failure caused by information, instructions or source material you provide where the resulting issue could not reasonably have been identified or avoided by us.
We do not exclude or limit responsibility where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot lawfully be excluded.
Rememoir's consumer services are intended primarily for personal use. If you require work for a commercial purpose, tell us before ordering.
15
General terms
If part of these terms is found unlawful or unenforceable, the remaining terms continue so far as the law allows.
If we do not enforce a term immediately, that does not automatically mean we have waived it.
We may update these terms as Rememoir develops. The terms applying to a paid order will be those made available when that order is entered into, unless a change is required by law or you agree otherwise.
These terms are governed by the law of Scotland. This does not deprive a consumer living elsewhere in the UK of mandatory protections or court rights available to them under applicable consumer law.
16
Contacting us
If anything in these terms is unclear, or you have a question about an existing request, changing your mind or a problem with a Rememoir service, please use our Contact page. Questions are always welcome.
Please include your Rememoir reference where you have one.
The principle behind these terms
Know what you're buying.
Know what to expect.
Important conditions should be clear before you pay, not discovered afterwards.
